Surrogacy case: SRK seeks dismissal of plea
Actor Shahrukh Khan has sought dismissal of a petition filed by social activist Varsha Deshpande seeking early hearing of the complaint filed by her in a magistrate court seeking action against him for sex determination of their third surrogate child.
Shahrukh's lawyer Pranav Badhekar on September 26 requested the Bombay High Court to dismiss the petition on the ground that neither Deshpande nor her lawyers were present in the magistrate court when the matter was posted for arguments on September 24.
Deshpande had filed a complaint in the magistrate court seeking action against Shahrukh Khan, his wife Gauri, Jaslok hospital and its doctor and officials of the Brihanmumbai Municipal Corporation (BMC) under the Pre-conception and Pre-Natal Diagnostic Techniques (Prohibition of Sex Selection) Act.
Deshpande had alleged that the star couple had conducted pre-birth sex determination tests of their surrogate son AbRam.
Deshpande had approached the High Court seeking an early hearing into her complaint on the ground that the Supreme Court had said that all cases under the PCPNDT Act should be heard and decided within six months.
"In the magistrate court all the respondents filed their replies on September 20 and the matter was kept for arguments on September 24. However, on that day no one was present on behalf of the complainant and the matter was adjourned," Shahrukh's lawyer Badhekar told the court.
Seeking dismissal of the petition, Badhekar and BMC lawyer M P S Rao said that the petition has become infructuous and need not be entertained.
Justice Jadhav directed Badhekar to file a short affidavit by September 30 bringing this on record and also the order passed by the magistrate court on September 24 adjourning the hearing.
The civic body had earlier told the court that it had conducted an inquiry into the allegations of sex determination and found it baseless.
I bet they are too embarrassed to show their faces....I hope they are never allowed to forget their stupidity
OMG realised its already Midnight in India. means now the 27th May. can't belive how fast one year is around. Happy first Birthday AbRam

High court relief for Shah Rukh Khan in surrogacy case
MUMBAI: The Bombay high court on Thursday dismissed a petition filed by activist Varsha Deshpande against a lower court order not allowing her access to records of the surrogate mother in the case of actor Shahrukh Khan's new born last year.
Justice Revati Mohite Dhere dismissed the criminal writ petition filed by Deshpande against an order of a magistrate of October 23, 2013 which had rejected her application under section 28(3) of the PCPNDT Act, seeking directions to the BMC to produce all records of the surrogate mother and test conducted on her in order to support her case. Her case was that the doctors had allegedly violated the PCPNDT Act that prohibits sex determination of a fetus.
Deshpande had sought prosecution of the actor, his wife and their doctors on the basis of a news report in a city tabloid in June 2013 which claimed that the star couple were having a baby boy through surrogacy.
Advocate Pranav Badheka denied that his client Shahrukh Khan had gone in for any sex determination test as alleged in the complaint. The baby was it was already born when the article appeared, pointed out Badheka as he argued that it was a case of baseless allegations to seek publicity. Counsel M P S Rao also said that there was no case made out for issuance of documents to Deshpande
Deshpande's lawyer Uday Warunjikar had earlier sought a speedy time bound hearing of the case before the magistrate as mandated by the special legislation enacted to prevent female foeticide.
The HC however allowed the case to proceed before the magistrate and declined a plea by Warunjikar to stay its order for eight weeks.
Let's hope that's the end of it and this silly lady can now get on with fighting the cause she is so rightly passionate about in places where it is a real issue.
